Proceedings: BC Commissioners 5-3-17






The Bennett County Board of Commissioners met in regular session Wednesday, March 3, 2017, in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Chairman Jason Fanning.

Commissioners present: Rolf Kraft, Jason Fanning, Rocky Risse, and Jeff Slattery.

Absent: Wayne Bond.

Others Present: Susan Williams, Auditor; Tim Huether, Bennett County Booster; Jeff Siscoe, Director or Equalization; Jesse Ulmer, Tony Waters, and Mary Buchy, Area Residents; Rod Anderson, Area Land Owner; and Ali DeMersseman, Executive Director, Black Hills Council of Local Governments.

Minutes Approved

The minutes of the April 19, 2017, meeting were approved with the addition that the County would transfer the Hospital and Nursing Home building and land contingent on a legal review. Rocky Risse made the motion and Rolf Kraft seconded.

All voted aye. Motion carried.

Rocky Risse made a motion to approve the April 19, 2017, Board of Equalization minutes. Jeff Slattery seconded.

All voted aye. Motion carried.

Auditor’s Account with Treasurer

To the Honorable Board of County Commissioners of Bennett County:

I hereby submit the following report of my examination of the cash and cash items in the hands of the County Treasurer of this County as of April 30, 2017.

April Report

Register of Deeds: $2,248.50

Highway Department

Rocky Risse reported the department is blading roads. There was discussion about a timeline for hauling gravel.

The Board reviewed maps for the South Dakota Department of Transportation project on U.S. Highway 18 east of Vetal to the Bennett/ Todd County line.

Rolf Kraft made a motion to accept an agreement with the South Dakota Department of Transportation for project P-PH 0018 (198) 173 PCN 04XH to allow the Bennett County Chairman the authority to negotiate and approve of acquisition of right of way for the project. Jeff Slattery seconded.

All voted aye. Motion carried.

A group of area residents, including Tony Waters, Jesse Ulmer, and Mary Buchy, met with the Board with complaints about the county roads. The complaints included not blading the whole road, leaving machines in the country instead of driving them back and forth, snow not being removed from bus routes, and the conditions of the roads.

The Board explained they are trying to get all the roads done. The County has minimum funds, over 600 miles of roads, and not enough equipment or manpower. There was also a complaint about the road north of Allen to the Jackson County line. Tony Waters requested the road be bladed and pot holes filled since it is a bus route and an emergency route and has a lot of traffic. There was discussion concerning working with the tribe on maintenance of the roads.

The Board thanked the group and stated they are working hard to get all the roads done.

Tuthill Streets

Rod Anderson, area land owner, met with the Board to request that Mott Street in Tuthill be closed. Mr. Anderson explained there are problems with fences and property lines between neighbors. Mr. Anderson stated he would be discussing the problems with the State’s Attorney.

There was discussion concerning the need to have a plat done of the property. The Board requested the Director of Equalization and the States Attorney investigate the property to determine the County’s options. The Board agreed there should not be any more movement on any property until the matter is settled.

Black Hills Council of Local Governments

Ali DeMersseman, Executive Director of Black Hills Council of Local Governments, met with the Board to inform them about the services they provide. Ms. DeMersseman discussed with the Board some of the needs and options of a planning and zoning board for Bennett County. The Board agreed they would like to look at a simplified plan. Ms. DeMersseman will check on some ordinances the County could consider.

Highway Superintendent

The Board requested the Auditor advertise for a Highway Superintendent again.


There being no further business to come before the Board, Rolf Kraft made a motion to adjourn with a second by Rocky Risse.
