Proceedings: BC Commissioners 5-17-17






The Bennett County Board of Commissioners met in regular session Wednesday, May 17, 2017, in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Chairman Jason Fanning.

Commissioners present: Jason Fanning, Jeff Slattery, Rolf Kraft, and Rocky Risse.

Absent: Wayne Bond.

Others present: Margaret Oleske, Deputy Auditor; David McDonnell, Area Resident; and Rod Anderson, Area Resident.

Minutes Approved

Rolf Kraft made a motion to approve the May 3, 2017, meeting minutes. Jeff Slattery seconded.

All voted aye. Motion carried.

Highway Department

There was discussion concerning the loading of gravel from the pits. David McDonnell, area resident, visited with the Commissioners about the timing of finishing the work being done on the Lower Refuge Road. He reported that about two miles of the road work had not been finished, which left inconsistent patches that were bad. Commissioner Fanning remarked that from visiting with the crew at Lacreek, they planned to have the work finished by this Fall. It was agreed that the increased rains would delay the work until gravel trucks could travel the road.


The Board reviewed claims. Rolf Kraft made a motion to approve claims subject to delinquent taxes. Jeff Slattery seconded.

All voted aye. Motion carried.

Fund Transfer

The Commissioners approved a funds transfer of $6,000.00 from the General Fund to Emergency and Disaster as provided in the budget.

2017-2018 Malt Beverage Licenses

Malt Beverage Licenses were approved for R Bar and Grill, and Boomdocks Bar and Grill with a motion from Rocky Risse, and second by Rolf Kraft.

All voted aye. Motion carried.

Resolution #1-2017

The Commissioners examined Resolution #1-2017, pertaining to the England School Tract Plat, located in Vetal. The Resolution was approved with a motion by Rolf Kraft, and second by Jeff Slattery.

All voted aye. Motion carried.


England School Tract

WHEREAS; there has been presented to the Board of Commissioners of Bennett County, South Dakota, the plat containing a portion of tract 2 as described in book 20 of deeds on page 570 and a portion of the balance of the SD ¼ , all in section 31, T38N, R34W, 6th P.M., Bennett County, South Dakota and;

WHEREAS; it appears to this Board that the system of streets set forth therein conforms to the system of streets of existing plats and Section lines of the County, adequate provision is made for access to adjacent unplatted lands by public dedication or section line when physically accessible, all provisions of the County subdivision regulations have been complied with, all taxes and special assessments upon the property have been fully paid, and the plat and survey have been lawfully executed.

NOW, THEREFORE, BE IT RESOLVED, that said plat is hereby approved in all respects.

Motion passed and Resolution #1-2017 adopted this 17th day of May, 2017.

Executive Session

Rocky Risse called for executive session with States Attorney Sarah Harris at 9:50 a.m. Rolf Kraft seconded.

All voted aye. Motion carried.

Chairman Jason Fanning declared executive session closed at 10:50 a.m.

Public Discussion

Rod Anderson, area resident, visited with the Commissioners concerning the closing of an alley in Tuthill. The Commissioners agreed to consider the matter at a later date.


There being no further business to come before the Board, Rolf Kraft made a motion to adjourn with a second by Rocky Risse.

All voted aye. Motion carried.
