The Bennett County Board of Commissioners met in regular session Wednesday, July 5, 2017, in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Chairman Jason Fanning, in the Commissioners room.

Commissioners present: Jason Fanning, Wayne Bond, Rolf Kraft, Jeff Slattery, and Rocky Risse.

Others Present: Susan Williams, Auditor; Tim Huether, Bennett County Booster; Sarah Harris, States Attorney; Jeff Siscoe, Emergency and Disaster Coordinator; Rod Anderson, Eldon Cassidy, Donald Richards, Mike McCracken and Helen Novak, area residents. 

Minutes Approved

The minutes of the June 21, 2017, meeting were approved with a motion by Wayne Bond and a second by Jeff Slattery. 

All voted aye. Motion carried.

Auditor’s Account with Treasurer

To the Honorable Board of County Commissioners of Bennett County:

I hereby submit the following report of my examination of the cash and cash items in the hands of the County Treasurer of this County as of June 30, 2017.

Balance on hand – County $3,940,748.36; Cash Change Account $350.00; Restricted Funds $326,725.23; Savings Accounts $0.00; Cash, Checks, Credit Cards $9,084.98; Treasurer’s Change Fund - $150.00; NSF Checks $447.00

June Monthly Report

Register of Deeds: $3,113.50

Highway Department

Rocky Risse reported the Highway department is blading roads and hauling gravel. There was discussion concerning private citizens purchasing gravel without prior approval from the Commissioners. The Board agreed they must have a request from the land owner first. There was discussion concerning gravel pits. Auditor Susan Williams reported there had not been response to employment advertisements. 

All voted aye. Motion carried.

County Rangeland Fire Agreement

Jeff Siscoe, Emergency and Disaster Coordinator, met with the Board to report on information he received about the County Rangeland Fire Agreement. Mr. Siscoe explained the terms of the agreement and recommended signing the agreement. After discussion Rolf Kraft made a motion to sign the County Rangeland Fire Protection Agreement with the Wildland Fire Division of the South Dakota Department of Agriculture. Jeff Slattery seconded.

All voted aye. Motion carried.

Resolution #2-2017

Rolf Kraft made a motion to approve Resolution #2-2017 Bennett County Rangeland Fire Protection Agreement Designation to Request Assistance. Jeff Slattery seconded.

Resolution #2-2017

Bennett County Rangeland Fire Protection Agreement Designation To Request Assistance

WHEREAS, Bennett County will enter into a County Rangeland Fire Protection Agreement with the South Dakota Department of Agriculture, Wildland Fire Division, and

WHEREAS; the Bennett County Board of Commissioners will designate an individual authorized to request rangeland fire assistance.

NOW, THEREFORE, BE IT RESOLVED, that the Bennett County Board of Commissioners authorize the Martin Volunteer Fire Chief, as per SDCL 41-20A-11, the authority to request assistance. The authority, as provided, shall continue in full force and effect until terminated or modified by resolution of the Bennett County Board of Commissioners.

Motion passed and Resolution #2-2017 adopted this 17th day of June, 2017.

Resolution #3-2017

Rolf Kraft made a motion to approve Resolution #3-2017 Bennett County Rangeland Fire Protection Agreement County Rural Fire Coordinator. Jeff Slattery seconded.

All voted aye. Motion carried

Resolution #3-2017

Bennett County Rangeland Fire Protection Agreement County Rural Fire Coordinator.

WHEREAS, Bennett County will enter into a County Rangeland Fire Protection Agreement with the South Dakota Department of Agriculture, Wildland Fire Division, and

WHEREAS, the Bennett County Board of Commissioners will appoint a Bennett County Rural Fire Coordinator to act as a single point of contact.

NOW, THEREFORE, BE IT RESOLVED, that the Bennett County Board of Commissioners appoint Jeff Siscoe, Bennett County Emergency and Disaster Coordinator, as County Rural Fire Coordinator for Bennett County. The County Rural Fire Coordinator is hereby authorized to act as a single point of contact, on behalf of Bennett County, in dealing with administrative matters such as burn bans, billings or questions about the Rangeland Fire Agreement specific to Bennett County. This authority shall continue in full force and effect until terminated or modified by resolution of the Bennett County Board of Commissioners.

Noxious Weeds

The Board discussed the noxious weed problem in Bennett County. There was a suggestion to contract for weed control. The County has chemical on hand. Mr. Kraft will contact someone about spraying and Mr. Risse will check on noxious weed locations. There was discussion about weed problems on private property.

2018 Budget

The Board reviewed the 2018 Budget requests.

Vacate Streets Hearing

The Commissioners held a hearing to consider a petition filed by Rodney and Dianna Anderson and Wesley and Carol Risse to close Mott Street in Tuthill, SD and petition filed by Rodney and Dianne Anderson to close a portion of Jones Street in Tuthill, SD. The hearing was held at 10:30 a.m. Those attending the hearing were Rodney Anderson, Donald Richards, Eldon Cassidy, Michael McCracken, and Helen Novak. States Attorney Sarah Harris explained to the Board that Mr. Anderson had filed the proper paperwork. Mr. Anderson explained that the streets were not used and the petitioners own the property adjacent to the portions they are requesting closed. Mr. McCracken presented a protest to closing the streets and presented the Commissioners and the States Attorney with an affidavit of protest to the vacating of the streets. There was discussion concerning the wording of the original plat for Tuthill which is unincorporated town. States Attorney Sarah Harris advised the Board to take the information under consideration before a decision is made.

Executive Session

Rolf Kraft made a motion to go into executive session with States Attorney Sarah Harris and Director of Equalization Jeff Siscoe at 11:00 a.m. to discuss legal matters. Wayne Bond seconded.

All voted aye. Motion carried.

Chairman Jason Fanning declared executive session closed at 11:30 a.m.

Wayne Bond made a motion to go into executive session with States Attorney Sarah Harris concerning legal issues at 11:40 a.m. Jason Fanning seconded.

All voted aye. Motion carried.

Chairman Jason Fanning declared executive session closed at 11:45 a.m.

There being no further business to come before the Board, Wayne Bond made a motion to adjourn with a second by Rolf Kraft.
