The Bennett County Board of Commissioners met in regular session Wednesday, November 15, 2017, in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Vice Chairman Wayne Bond.

Commissioners present: Wayne Bond, Jeff Slattery, Rolf Kraft and Rocky Risse.

Jason Fanning arrived at 9:40 a.m.

Others present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Sarah Harris, States Attorney.

Minutes Approved

The minutes of the regular November 1, 2017, meeting were approved with a motion by Rocky Risse and a second by Jeff Slattery.

All voted aye. Motion carried.

Chairman Jason Fanning arrived at 9:40 a.m. and assumed control of the meeting.

Highway Department

A request was presented concerning the Old Highway 18 maintenance. It was reported roads are being bladed at this time.

Claims

The Board reviewed claims. Wayne Bond made a motion to approve all the claims subject to delinquent taxes. Jeff Slattery seconded. 

All voted aye. Motion carried.

Liquor Licenses

The Commissioners reviewed license applications for 2018 Retail On-Sale Liquor Licenses. Rocky Risse made a motion to approve the following applications:

Resolution #9-2017

The Board reviewed Resolution #9-2017. Rocky Risse made a motion to approve Resolution #9-2017, A Resolution of the Bennett County Commission Vacating Mott Street and a Portion of Jones Street in Tuthill, Bennett County South Dakota. Wayne Bond seconded.

All voted aye. Motion carried.

RESOLUTION #9-2017

A Resolution Of The Bennett County Commission Vacating Mott Street And A Portion Of Jones Street In Tuthill, 

Bennett County South Dakota 

WHEREAS, South Dakota Codified Laws §31-3-7, provides for vacation of streets; and 

WHEREAS, Rodney Anderson, Dianna Anderson, Wesley Risse and Carol Risse have petitioned the Bennett County Board of Commissioners to vacate Eight hundred thirty-three feet (833’) of Mott Street, abutting lots Twenty-six (26) thru lots Fifty (50) of Block Two (2) on the East side, the western sixty feet (60’) of Jones Street and lot Twelve (12) of Block Three (3) on the East side, in Tuthill, Bennett County South Dakota, as shown in Plat Book No. 1, File 8A, of the Bennett County Register of Deeds, Martin, South Dakota; and

WHEREAS; Rodney Anderson and Dianna Anderson have petitioned the Bennett County Board of Commissioners to vacate the West one hundred fifty feet (150’) of Jones Street, abutting Lot Twenty-six (26) of Block Two (2) on the North and Lots Twelve (12) Thru Seven (7) of Block Three (3) on the South, in Tuthill, Bennett County, South Dakota, as shown in Plat Book No. 1, File 8A, of the Bennett County Register of Deeds, Martin, South Dakota; and

WHEREAS, the Bennett County Board of Commissioners held a public hearing pursuant to SDCL §31-3-7; and

WHEREAS, the Bennett County Board of Commissioners have considered whether the public interest would be better served by such proposed vacations, the reasons set forth by the petitioners and all other arguments provided at the July 15, 2017 public hearing and all documents submitted thereafter. 

NOW, THEREFORE, IT IS HEREBY RESOLVED, that the Bennett County Board of Commissioners, pursuant to SDCL §31-3-8, hereby order that the Eight hundred thirty-three feet (833’) of Mott Street, abutting lots Twenty-six (26) thru lots Fifty (50) of Block Two (2) on the East side, the western sixty feet (60’) of Jones Street and lot Twelve (12) of Block Three (3) on the East side, in Tuthill, Bennett County South Dakota, as shown in Plat Book No. 1, is vacated. 

NOW, THEREFORE, IT IS FURTHER RESOLVED, that the Bennett County Board of Commissioners, pursuant to SDCL §31-3-8, hereby order that the one hundred twenty-five feet (125’) by sixty feet (60’) of Jones Street, abutting lots Eight (8) thru Twelve (12) of Block Three (3), in Tuthill, Bennett County, South Dakota, as shown in Plat Book No. 1, is vacated.

Motion passed and Resolution #9-2017 adopted this 15th day of November, 2017.

Resolution #10-2017

 The Board reviewed Resolution #10-2017. Wayne Bond made a motion to approve Resolution #10-2017 Tract 1 of Hicks Tract 1 plat. Rolf Kraft seconded.

All voted aye. Motion carried.

RESOLUTION #10-2017

TRACT 1 OF HICKS TRACT 1

WHEREAS; there has been presented to the Board of Commissioners of Bennett County, South Dakota, the plat of Hicks Tract 1, a subdivision of the W ½ NE ¼ and the SE ¼ of Section 17, Township 39 North, Range 37 West of the sixth principal meridian, Bennett County, South Dakota and;

WHEREAS; it appears to this Board that all taxes upon the property have been fully paid and the plat of the above described property has been executed according to statute.

NOW, THEREFORE, BE IT RESOLVED, that said plat is hereby approved in all respects.

Motion passed and Resolution #10-2017 adopted this 15th day of November, 2017.

Indigent Burial Request

The Board considered a request for an indigent burial. The Board tabled a decision until there is more information.

States Attorney

States Attorney Sarah Harris reported that the County received $1,362.42 for a juvenile fiscal diversion incentive program for six successful juveniles that the States Attorney’s office had submitted.

Ms. Harris informed the Commissioners her office needed to update the computers. The Board agreed to the updates.

Randall Reservoir District Meeting

The Board discussed the Randall Reservoir District meeting Bennett County hosted on November 13, 2017 and agreed the meeting was well attended and productive. 

Tax Exempt Trust Land Letter

Rolf Kraft presented a letter to the Board with a request that other Commissioners join together to meet with federal representatives concerning funding for tax exempt trust land. Mr. Kraft explained he wanted to send the letter out to all counties. The Board agreed he should send the letter.

Executive Session

Jason Fanning made a motion to go into executive session at 10:13 a.m. with States Attorney Sarah Harris concerning possible litigation. Rolf Kraft seconded.

All voted aye. Motion carried.

Chairman Jason Fanning declared executive session closed at 10:30 a.m.

There being no further business to come before the Board, Wayne Bond made a motion to adjourn with a second by Rolf Kraft.
