The Bennett County Board of Commissioners met in regular session Wednesday, May 2, 2018 in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Chairman Jason Fanning.

Commissioners present: Jason Fanning, Rolf Kraft, Jeff Slattery and Rocky Risse. 

Absent: Wayne Bond.

Others Present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Judd Schomp, Area Resident; Robert Ceplecha, Area Resident; Jolene Donovan, Treasurer; Dan O’Neill, Area Resident; Scott Peterson, Peterson Beel, LLP; Seymour Young Dog, Robert Buresh, Margaret Young Dog, Bryan Kehn, Sharon Two Crow, Nancy Rouillard, Robert Two Crow, Virginia Irving, Area Residents; and Craig Dillon, Tribal Council Representative. 

Minutes Approved

The minutes of the regular April 18, 2018 meeting were approved with a motion by Rolf Kraft and second by Jeff Slattery.

All voted aye. Motion carried

The minutes of the April 18, 2018 Bennett County Board of Equalization were approved with a motion by Jeff Slattery and a second by Rolf Kraft.

All voted aye. Motion carried

Auditor’s Account with Treasurer

To the Honorable Board of County Commissioners of Bennett County:

I hereby submit the following report of my examination of the cash and cash items in the hands of the County Treasurer of this County as of April 30, 2018.

Balance on hand – County $ 4,716,083.63; Cash Change Account $ 250.00; Restricted Funds $ 301,282.94; Savings Accounts $ 0.00; Cash, Checks, Credit Cards $ 171,695.08; Treasurer’s Change Fund - $ 150.00; NSF Checks $529.27; TOTAL $ 5,189,690.92

April Report

Register of Deeds: $3,345.00

Area Residents 

A group of residents that live on 199th Avenue met with the Board concerning road conditions. The group reported that there has not been any maintenance on the road from the Divan residence north; there is mud and wash outs and no gravel. The group stated there are school children, teachers and elderly residents that live on the road and there is concern for their safety. 

The Commissioners agreed the road needed work and the Highway Department would look at it. Representative Dillon stated if the County would do work on the County road then the tribe would work on the tribal road.

Highway Department

Jeff Slattery explained to the Board that he felt the Highway Department should consider purchasing a new grader. The Board agreed to meet with a motor grader dealer.

There was discussion concerning bidding for gravel hauling. The Board discussed terms of the bid with Robert Ceplecha. Rocky Risse stated the Highway Department will work with the successful bidder. There was also discussion concerning meeting with James Cross about a haul agreement with the tribe.

Commissioners June Meeting

The Board agreed to change the date of the June 6, 2018 meeting to June 7, 2018 at 9:30 a.m. due to the Primary Election on June 5, 2018.

Conference call

A conference call was made to Terry Zell, Legislative Audit, to finalize the 2015-2016 Audit. Mr. Zell reported on the audit findings to the Board.

Plats

Daniel O’Neil and Scott Peterson, Attorney, met with the Board to discuss several plats the Board was considering.

Rocky Risse made a motion to approve Resolution #7-2018 Plat Surveys. Rolf Kraft seconded. 

All voted aye. Motion carried

Resolution #7-2018

Plat Surveys

WHEREAS; there has been presented to the Board of Commissioners of Bennett County, South Dakota, the plat of the land described herein platted as Tract 1 and Tract 2, located in the south ½ of the South ½ of Section 36, T37N, R34W of the 6th P.M., Bennett County, South Dakota and;

WHEREAS; there has been presented to the Board of Commissioners of Bennett County, South Dakota, the plat of the land described herein platted as Tract 1, located in Section 31, T37N, R33W of the 6th P.M., Bennett County, South Dakota and;

WHEREAS; there has been presented to the Board of Commissioners of Bennett County, South Dakota, the plat of the land described herein platted as Tract 1 and Tract 2, located in the Section 2, T36N, R34W, of the 6th P.M., Bennett County, South Dakota and;

WHEREAS; there has been presented to the Board of Commissioners of Bennett County, South Dakota, the plat of the land described herein platted as Tract 1 and Tract 2, located in Section 1, T36N, R34W of the 6th P.M., Bennett County, South Dakota and;

WHEREAS; there has been presented to the Board of Commissioners of Bennett County, South Dakota, the plat of the land described herein platted as Tract 1 and Tract, located in Section 7, T36N, R33W of the 6th P.M., Bennett County, South Dakota.

WHEREAS; it appears to this Board that all taxes upon the property have been fully paid and the plats of the above described property has been executed according to statute.

NOW, THEREFORE, BE IT RESOLVED, that said plats are hereby approved in all respects.

Motion passed and Resolution #7-2018 adopted this 2nd day of May, 2018.

Tax Rolls

Treasurer, Jolene Donovan met with the Board to report Zillow had requested the current tax rolls. The Commissioners informed Ms. Donovan the fee for the report is $10,000.00.

County Opt-Out

There was discussion concerning a publication in the Booster about the reasons for the need of a County Opt-Out and what information to include. The Commissioners agreed to hold a public meeting May 24, 2018 at 7:00 p.m. in the Courthouse.

Executive Session

Rocky Risse made a motion to go into executive session at 11:36 a.m. concerning possible litigation. Rolf Kraft seconded. 

All voted aye. Motion carried

Chairman Jason Fanning declared executive session closed at 11:50 a.m.

There being no further business to come before the Commissioners, Jeff Slattery made a motion to adjourn with a second by Rolf Kraft.

All voted aye. Motion carried.
