The Bennett County Board of Commissioners met in regular session Thursday, June 7, 2018 in the Courtroom.

The meeting was called to order at 9:30 a.m. by Chairman Jason Fanning.

Commissioners present: Jason Fanning, Rolf Kraft, Jeff Slattery, Rocky Risse and Wayne Bond.

Others Present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Sarah Harris, States Attorney; Judd Schomp, Area Resident; Bob Ceplecha, Ceplecha Trucking; Jonathan Bad Wound, area resident; Paul Noel, City Foreman. 

Minutes Approved

The minutes of the regular May 16, 2018 meeting were approved with a motion by Rolf Kraft and second by Wayne Bond.

All voted aye. Motion carried

Auditor’s Account with Treasurer

To the Honorable Board of County Commissioners of Bennett County:

I hereby submit the following report of my examination of the cash and cash items in the hands of the County Treasurer of this County as of May 31, 2018.

Balance on hand – County $4,731,633.72; Cash Change Account $250.00 ; Restricted Funds $301,285.55; Savings Accounts $0.00; Cash, Checks, Credit Cards $ 14,133.33; Treasurer’s Change Fund - $ 150.00; NSF Checks $200.00; TOTAL $ 5,047,352.60

Highway Department

Executive Session

Rocky Risse made a motion to go into executive session at 9:32 a.m. concerning personnel. Rolf Kraft seconded. 

All voted aye. Motion carried

Chairman Jason Fanning declared executive session closed at 9:40 a.m.

New Hire 

Jeff Slattery made a motion to approve the hire of Jonathan Bad Wound, Highway Department Part-time Seasonal, $10.00 hourly, effective May 21, 2018. Rocky Risse seconded.

All voted aye. Motion carried

There was some discussion concerning the repair record on the 2012 John Deere 772 G motor grader the Commissioners were considering leasing. 

Rocky Risse made a motion to rescind the May 16, 2018 motion to lease the 2012 John Deere 772 G motor grader. Wayne Bond seconded.

All voted aye. Motion carried

New Hire

Jeff Slattery made a motion to approve the new hire of Christian Means, Highway Labor, $10.00 hourly, effective June 7, 2018. Wayne Bond seconded.

All voted aye. Motion carried

Rural Attorney Incentive Program

Auditor Susan Williams informed the Commissioners that Amanda LaCroix has been sworn in as an attorney in the rural attorney incentive program. The cost for the County will be $4,379.76 per year for 5 years. 

Fred and Luella Cozad have pledged $10,000.00 with the County share $2,379.76 per year for 5 years. There was discussion concerning a request to the City Council to pay half at $1,189.88 per year for 5 years. Jason Fanning stated he will contact the City.

New Hire

Wayne Bond made a motion to approve the new hire of Michael Conquering Bear, Part-time Transport/ Jailer, $10.00 hourly, effective May 4, 2018. Rolf Kraft seconded.

All voted aye. Motion carried

States Attorney

Executive Session

States Attorney Sarah Harris requested executive session concerning legal issues at 9:53 a.m. Wayne Bond made the motion. Rocky Risse seconded. 

All voted aye. Motion carried

Chairman Jason Fanning declared executive session closed at 10:00 a.m.

Gravel Hauling Bids

At 10:00 a.m. the Board opened bids for gravel hauling. Bids were submitted by Ceplecha Trucking and Grading, $7.14 per loaded mile or $257,040.00 per 1200 loads of 23 ton with a 30 mile average. 

Flat Creek Construction LLC, $5.87 per 23 ton mile. 

Rocky Risse made a motion to accept the bid from Flat Creek Construction LLC at $5.87 per 23 ton load. Jeff Slattery seconded.

All voted aye. Motion carried

Primary Election canvass

The Commissioners canvassed the votes for the June 5, 2018 Primary Election. Wayne Bond made a motion to accept the canvass of the June 5, 2018 Primary Election. Jeff Slattery seconded.

All voted aye. Motion carried

Justus Building excavator bill

Paul Noel, City Foreman, met with the Board to discuss the Justus Building. Mr. Noel presented the County’s share of the bill for the excavator used to tear down the building. The Board thanked Mr. Noel and the City for the project.

There being no further business to come before the Commissioners, Wayne Bond made a motion to adjourn with a second by Jeff Slattery.

All voted aye. Motion carried.
