The Bennett County Board of Commissioners met in regular session Wednesday, September 19, 2018, in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Chairman Jason Fanning.

Commissioners present: Jason Fanning, Rocky Risse, Rolf Kraft and Jeff Slattery.

Absent: Wayne Bond

Minutes Approved

There was discussion concerning miscommunication about a motion made at the September 5, 2018 meeting. Rolf Kraft stated the motion to withdraw the offer to Terry Smokov for Highway Superintendent was a motion to withdraw the vacancy for the Highway Superintendent position. Mr. Kraft explained the motion to withdraw the vacancy was not a reflection on the applicant but a normal procedure available to Boards.

Jeff Slattery made a motion to approve the September 5, 2018 minutes with the change to the motion of withdraw the Highway Superintendent offer to withdraw the Highway Superintendent vacancy. Rocky Risse seconded.

All voted aye. Motion carried.

Highway Department

Jeff Slattery made a motion to approve Tom Jacquot, Temporary Highway Labor, $13.00 hourly, effective September 1, 2018. Rolf Kraft seconded.

All voted aye. Motion carried.

Jerry Emerick, Area Resident, met with the Board to request maintenance on the Tuthill road. Mr. Emerick explained the road is rough and needs work. He commended Tom Jacquot on the job he did mowing ditches along the Tuthill Road. There was discussion concerning the County drag. Mr. Emerick suggested a 35 mph speed limit on the road to keep the road from being damaged but enforcement is difficult. Rocky Risse stated the Highway Department would be working on it but the conditions are really dry. Rocky Risse reported the Highway Department will be building up the road and fixing culverts in the western part of the county.


The Board reviewed claims. Rocky Risse made a motion to approve claims subject to delinquent taxes. Rolf Kraft seconded.

2019 Annual Budget

Jeff Slattery made a motion to approve Resolution #9-2018 adoption of Annual Budget for Bennett County. Rolf Kraft seconded.

Adoption Of Annual Budget For Bennett County South Dakota

Whereas, (7-21-5 thru 13), SDCL provides that the Board of County

Commissioners shall each year prepare a Provisional Budget of all contemplated expenditures and revenues of the County and all its institutions and agencies for such fiscal year and, 

Whereas, the Board of County Commissioners did prepare a Provisional Budget and cause same to be published by law, and

Whereas, due and legal notice has been given to the meeting of the Board of County Commissioners for the consideration of such Provisional Budget and all changes, elimination’s and additions have been made thereto.

NOW THEREFORE BE IT RESOLVED, That such provisional budget as amended and all its purposes, schedules, appropriations, amounts, estimates and all matters therein set forth, SHALL BE APPROVED AND ADOPTED AS THE ANNUAL BUDGET OF THE APPROPRIATION AND EXPENDITURES FOR Bennett County, South Dakota and all its institutions and agencies for calendar year beginning January 1, 2019 and ending December 31, 2019 and the same is hereby approved and adopted by the Board of County Commissioners of Bennett County, South Dakota, this 19th day of September, 2018.

The Annual Budget so adopted is available for public inspection during normal business hours at the office of the county auditor Bennett County, South Dakota. The accompanying taxes are levied by Bennett County for the year January 1, 2019, through December 31, 2019.

Golden West Easement

At the request of Golden West Telecommunications, Rocky Risse made a motion to approve a right of way for telecommunications installation for Sec 28 T 38 N R 37 W. Jeff Slattery seconded.

All voted aye. Motion carried

Approve New Hire

Rocky Risse made a motion to approve the new hire of Stuart Bucholz, Transport Officer, $8.85 hourly, effective September 9, 2018. Jeff Slattery seconded.

All voted aye. Motion carried

Security Issues

Sheriff Paul Williams and States Attorney Sarah Harris informed the Board there would be extra security for the sentencing of Rangler and Dan Ceplecha, September 26, 2018 and employees would have the option of closing their offices. 

Sheriff Williams requested any employee that chose to close their office would be paid for the day. The Board agreed.

SDACC Convention

Rolf Kraft reported on the County Convention in Pierre. Mr. Kraft informed the Board about a resolution for a ½ cent sales tax for counties for Capital Outlay.

He also stated there is a lot of apathy from other counties concerning trust land issues and not a lot of support from the South Dakota Association of County Commissioners.


There being no further business to come before the Commissioners, Rolf Kraft made a motion to adjourn with a second by Jeff Slattery.
