The Bennett County Board of Commissioners met in regular session Wednesday, October 17, 2018, in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Vice-Chairman Wayne Bond.

Commissioners present: Rolf Kraft, Jeff Slattery, Wayne Bond.

Absent: Jason Fanning, Rocky Risse

Others present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Scott Bauman, Bauman Brothers; Bob Ceplecha, Ceplecha Trucking; Sarah Harris, States Attorney; Judd Schomp, Area Resident; Bob Bucholz, Martin Cemetery Association; Bill Kuxhaus, Area Resident; Kristine Novak; Area Resident; Jim Johnson, Area Resident. 

Minutes Approved

The minutes of the regular October 3, 2018 meeting were approved with a motion by Rolf Kraft and second by Jeff Slattery.

All voted aye. Motion carried.

Highway Department

There was discussion concerning current road work. 

Wayne Bond made a motion to go into executive session at 9:39 a.m. with States Attorney Sarah Harris and area resident Scot Bauman concerning possible legal issues. Rolf Kraft seconded. 

All voted aye. Motion carried.

Vice-Chairman Wayne Bond declared executive session closed at 9:58 a.m. 

The Commissioners and Mr. Bauman discussed options for digging out gravel. Mr. Bauman stated the Bauman Brothers are looking at purchasing excavation equipment if the County would be interested. The Board agreed they would have to look at the costs. There was also discussion concerning use of a light meter for equipment at the Bauman Pit.

Rolf Kraft made a motion to go into executive session with States Attorney Sarah Harris and Bob Ceplecha at 10:16 a.m. concerning possible legal issues. Jeff Slattery seconded. 

All voted aye. Motion carried.

Vice-Chairman Wayne Bond declared executive session closed at 10:30 a.m.

Auction for County Tax Deed Property

At 10:30 a.m., Vice-Chairman Wayne Bond conducted an auction for county tax deed property. 

The following parcel was presented for sale: East 42 Ft. of Lot 1-2-3, Block 10, Original Town. There were no bids. 

There was discussion concerning the second property. 

Jeff Slattery made a motion to abate delinquent real estate taxes on First Addition, Block 5, Lot 22-23-24, East 3 Ft. of Alley. Rolf Kraft seconded. 

All voted aye. Motion carried.

Kristine Novak was the successful bidder for First Addition, Block 5, Lot 22-23-24, East 3 Ft. of Alley for $3,100.00

The Commissioners will make a final decision on approval of the sale at the November 8, 2018 meeting. 

Claims

The Board reviewed claims.  Rocky Risse made a motion to approve claims subject to delinquent taxes.  Rolf Kraft seconded.

All voted aye. Motion carried.

Road Complaints

Jim Johnson, area resident, met with the Commissioners to complain about the condition of the roads in the southeastern portion of the County. The Board agreed they would do what they could. 

Bob Bucholz, Martin Cemetery Association, met with the Commissioners to request gravel on the Cemetery road. The Board agreed there was a need and Jeff Slattery will contact the Highway Department to haul gravel to the road. 

Automatic Supplement

Auditor Susan Williams reported to the Board that the surplused 2006 Crown Vic patrol car had been sold. Jeff Slattery made a motion to approve an automatic supplement to the law budget in the amount of $600.00. Rolf Kraft seconded.   

All voted aye. Motion carried.

Change of Meeting Date

At the request of Auditor Susan Williams, the Board agreed to change the November 7, 2018 meeting to November 8, 2018 at 9:30 a.m.

Auditor Budget

Auditor Susan Williams informed the Board that due to the need to replace a computer in the Auditor’s office and an employee benefit that were not budgeted for, there was a possibility the budget would be over at the end of the year. 

Wind Generation

Rolf Kraft reported he had met with a company Wind Generation that is looking at wind generation on tribal land and some deeded land. Mr. Kraft stated these are early proposals but it could generate new taxes.

There being no further business to come before the Commissioners, Jeff Slattery made a motion to adjourn with a second by Rolf Kraft.

All voted aye. Motion carried.
