The Bennett County Board of Commissioners met in regular session Thursday, November 8, 2018 in the Court room.

The meeting was called to order at 9:30 a.m. by Chairman Jason Fanning.

Commissioners present: Jason Fanning, Rolf Kraft, Jeff Slattery, Rocky Risse and Wayne Bond.

Others Present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Scott Bauman, Area Resident; Rod Kirk and Judd Schomp, Commissioners-Elect; Sarah Harris, States Attorney; Tracee Livermont, Martin Addiction Recovery Center; Jolene Donovan, Treasurer; Amanda LaCroix, Attorney.

Minutes Approved

The minutes of the regular October 17, 2018 meeting were approved with a motion by Rolf Kraft and second by Jeff Slattery.

All voted aye. Motion carried.

Auditor’s Account with Treasurer

To the Honorable Board of County Commissioners of Bennett County:

I hereby submit the following report of my examination of the cash and cash items in the hands of the County Treasurer of this County as of October 31, 2018.

Total Amount of actual cash – County $4,588,506.33; Cash Change Account $250.00; Restricted Funds $301,580.47; Savings Accounts $0.00; Cash, Checks, Credit Cards $144,022.84; Treasurer’s Change Fund - $150.00; NSF Checks $0.00; TOTAL $5,034,209.64

October Report

Register of Deeds: $3,582.50

Highway Department

The Commissioners considered Highway concerns. The Board considered a proposal from the State for the painting of the center line on the County asphalt roads. 

The Board agreed they did not need it at this time. 

Wayne Bond made a motion to approve Ed Johnson as temporary Highway labor at $12.00 hourly. Rolf Kraft seconded.

All voted aye. Motion carried.

Jeff Slattery requested the approval of volunteer Highway labor.

Jeff Slattery made a motion to approve Jay Nies as Highway labor volunteer. Wayne Bond seconded. 

All voted aye. Motion carried.

There was discussion concerning a culvert that needed cleaned out along Mary Thomsen property. 

Rocky Risse stated they would look at it. 

Scott Bauman, Area Resident, met with the Commissioners to propose the County consider the use of an excavator at the Bauman Pit. Mr. Bauman explained the Bauman Brothers would purchase the excavator and charge the County $2.00 per ton of gravel moved instead of just the use of a loader. The Board agreed to try the process before making a decision. 

There was discussion about local truckers hauling gravel. The Board agreed to continue hauling gravel with outside truckers. 

2018 General Election Canvass

The Commissioners canvassed the votes for the 2018 General Election. 

Rolf Kraft made a motion to accept the canvass for the 2018 General Election votes. Wayne Bond seconded. 

All voted aye. Motion carried.

Tax Abatement of Property Taxes

The Board considered a request from Cynthia Babby for abatement of property taxes for 2019 due to loss of mobile home by fire May 18, 2018.

Jeff Slattery made a motion to abate a portion of 2019 Property taxes on SE1/4 SE1/4 W1/4 NW1/4 S29 T37 R37, Bennett County SD in the amount of $262.72. Wayne Bond seconded. 

All voted aye. Motion carried.

The Board considered a request for abatement of taxes on tax deed property taken by the County. 

Rocky Risse made a motion to abate 2015-2017 property taxes on First Addition, Blk 5 Lot 22-23-24 E 3 feet of Alley, Bennett County, SD in the amount of $615.01. Wayne Bond seconded. 

All voted aye. Motion carried.

Tax Deed Property Sale

Wayne Bond made a motion to accept the tax deed sale of First Addition, Blk5, Lot 22-23-24 E 3 feet of alley, Bennett County, SD to Kristine Novak in the amount of $3,100.00. Jeff Slattery seconded. 

All voted aye. Motion carried.

South Dakota Game, Fish, and Parks Contract

Wayne Bond made a motion to approve a lease agreement with the Department of Game, Fish and Parks for office space for 5 years commencing November 1, 2018. Rolf Kraft seconded. 

All voted aye. Motion carried.

County Health Insurance

Auditor Susan Williams informed the Board there would be a 6% increase to the County Health Insurance for 2019. There was some discussion. A final decision will be made at the next meeting. 

Gravel Crushing Bids

There was discussion about crushing more gravel at the May Pit. 

Rocky Risse made a motion to let for bids for 35,000 tons of gravel at 1” at the May Pit located in Jackson County S ½ Sec 24 T 41 R 40. Jeff Slattery seconded. 

All voted aye. Motion carried.

Indigent Medical Assistance

The Board reviewed an application requesting Medical Assistance. The Board agreed the applicant had other resources available. 

Wayne Bond made a motion to deny the request. Jason Fanning seconded. 

All voted aye. Motion carried.

Martin Addiction Recovery Center

Tracee Livermont representing the Martin Addiction Recovery Center, met with the Commissioners. Mrs. Livermont informed the Board that the Center is looking at building a new center due to the poor condition of the current building. 

She explained they are looking at grants and other funding and propose the County swap the County tax deed land on Main Street for the current MARC building. Mrs. Livermont explained they would demolish the current building if the project goes through. Rolf Kraft stated he supports the swap because of the service they provide. 

Mrs. Livermont explained the purpose of the Martin Addiction Recovery Center and the number of people they help. The Board agreed to the land swap if the funding for a new building is available.

Rolf Kraft made a motion to request the States Attorney draw up a letter of intent to swap Original Town E 42 foot of Lots 1-2-3, Blk 10 with Original Town, Blk 8; (25x88). 

Wayne Bond seconded. 

Voting Aye: Jason Fanning, Wayne Bond, Jeff Slattery, Rolf Kraft

Abstain: Rocky Risse

There being no further business to come before the Board, Rolf Kraft made a motion to adjourn with a second by Jeff Slattery.

All voted aye. Motion carried.
