Sealed Bids for the construction of the MARTIN WATER MAIN IMPROVEMENTS will be received, by City of MARTIN, SD at City Hall, 101 Main Street, MARTIN, SD 57559 until 2:00 p.m., Mountain Time on January 24, 2019, at which time the Bids received will be “publicly” opened and read in City Hall. The Project consists of constructing approximately 20 LF 4” PVC Water Main, 1,923 LF 6” PVC Water Main, 66 LF 8” PVC Water Main, 541 LF 1” Copper Water Service, 735 Ton 6” Base Course, 502 Ton 6” Gravel Surfacing, 644 Tons Asphaltic Concrete, and other bid items.

Bids will be received for a single prime Contract. Bids shall be on a unit price basis as indicated in the Bid Form.

Prospective Bidders may examine the Bidding Documents at the Issuing Office on Mondays through Fridays between the hours of 8:00 a.m. and 5:00 p.m., and may obtain copies of the Bidding Documents from the Issuing Office as described below.

Bidding Documents also may be examined at various plan rooms; online at QuestCDN.com, Project #5779882; the office of the City of Martin, 101 Main Street, on Mondays through Fridays between the hours of 8:00 a.m. and 4:00 p.m.; and the office of the Engineer. 

Printed copies of the Bidding Documents may be obtained from the Issuing Office, during the hours indicated above, upon payment of a deposit of $0 for each set. If shipping is requested, the Issuing Office will transmit the Bidding Documents via delivery service and a non-refundable shipping charge shall be paid by prospective Bidder. The shipping charge amount will depend on the shipping method selected by the prospective Bidder. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office.

The fair share objective for this project is 1% Minority Business Enterprise (MBE) and 4% Women’s Business Enterprise (WBE).

The successful Bidder and subcontractors in performance of the construction work will be required to comply with all applicable federal labor laws including minimum wage rates decisions of the United States Department of Labor (Davis-Bacon Act).

All bids are to be submitted on the basis of cash payment for the work and materials, and each bid shall be accompanied by a certified check for five percent (5%) of the amount of the bid, such check to be certified or issued by either a state or national bank and payable to the City of Martin, SD or in lieu thereof, a bidder’s bond in a sum equal to ten percent (10%) of the full amount of the bid.

The contractor shall not discriminate on the basis of race, color, national origin or sex in the performance of this contract. The contractor shall carry out applicable requirements of 40 CFR 33 in the award and administration of contracts awarded under EPA financial assistance agreements. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or other legally available remedies.

The low responsive bidder will be required to certify to compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of 2014. This certification form may be found on page AIS-21 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal.

Please be advised that waivers or exemptions from the American Iron and Steel provision that cite International Trade Agreements DO NOT comply with the Consolidated Appropriations Act of 2014 as it applies to the SRF programs. Claims from suppliers that the American Iron and Steel provision does not apply to certain products based on the International Trade agreement exemptions of the Consolidated Appropriations Act of 2014 will not be accepted.

Bidders on this work will be required to comply with the President’s Executive Orders Nos. 12138 (WBE), 11246 (Equal Employment) as amended, 11518 (Small Business Concerns), and 11625 (MBE) as amended.

A pre-bid conference will not be held for this project.
