The Bennett County Board of Commissioners met in regular session Wednesday, December 19, 2018, in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Chairman Jason Fanning.

Commissioners present: Jason Fanning, Rocky Risse, Jeff Slattery, Rolf Kraft and Wayne Bond.

Others present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Judd Schomp and Rod Kirk Commissioner Elects; Sarah Harris, States Attorney; Raymond Kocer Area Resident.

Minutes Approved

The minutes of the regular December 5, 2018 meeting were approved with a motion by Rolf Kraft and a second by Wayne Bond.

All voted aye. Motion carried.

Highway Department

Jason Fanning reported the Kennedy Implement tractors had been returned and a tire needed replaced on one of the tractors.

Jeff Slattery and Rod Kirk reported they had checked out the Bauman Pit and gravel has been stockpiled to be hauled when the weather permits.

The Board requested the Auditor place an ad for highway labor.

Raymond Kocer, Area Resident, met with the Commissioners to explain some of the history of the water problem on the Refuge. Mr. Kocer stated the water from the Refuge had been diverted in the 80’s and this was the reason for flooding of the adjacent land owners. Mr. Kocer requested the Board go to the Refuge to request the diversion be removed. Rocky Risse stated the sand has been cleaned out but the sand builds back up. There was continued discussion about the options concerning the water.

Claims

The claims were reviewed. Rocky Risse made a motion to approve claims subject to delinquent taxes. Jeff Slattery seconded.

All voted aye. Motion carried.

Plat Resolution #9-2018 and #10-2018

The Board reviewed two plats. Wayne Bond made a motion to approve Resolution #9-2018, Kroeger Tract 1 in Section 1 and 12. Rolf Kraft seconded.

All voted aye. Motion carried.

RESOLUTION #9-2018

KROEGER TRACT 1 IN SECTIONS 1 AND 12

WHEREAS; there has been presented to the Board of Commissioners of Bennett County, South Dakota, the plat of the land described herein platted as Kroeger Tract 1 located in Sections 1 and 12, T35N, R34W of the 6th P.M, Bennett County, South Dakota and;

WHEREAS; it appears to this Board that all taxes upon the property have been fully paid and the plat of the above described property has been executed according to law.

NOW, THEREFORE, BE IT RESOLVED, that said plat is hereby approved in all respects.

Motion passed and Resolution #9-2018 adopted this 19th day of December, 2018.

Wayne Bond made a motion to approve Resolution #10-2018, Plat of Burchfield Tract 1 and Burchfield Tract 2, Section 11, and Burchfield Tract 1 and Tract 2 in Section 12, T35N, R34W of the 6th P.M., Bennett County, South Dakota. Rolf Kraft seconded. 

All voted aye. Motion carried.

RESOLUTION #10-2018

PLAT OF BURCHFIELD TRACT 1 AND BURCHFIELD TRACT 2, SECTION 11, AND BURCHFIELD TRACT 1 AND TRACT 2 IN SECTION 12, T35N, R34W OF THE 6TH P.M., 

BENNETT COUNTY, SOUTH DAKOTA.

WHEREAS; there has been presented to the Board of Commissioners of Bennett County, South Dakota, the plat of the land described herein platted as Burchfield Tract 1 and Tract 2 in Section 11, and Burchfield Tract 1 and 2 in Section 12, T35N, R34W of the 6th P.M, Bennett County, South Dakota and;

WHEREAS; it appears to this Board that all taxes upon the property have been fully paid and the plat of the above described property has been executed according to law.

NOW, THEREFORE, BE IT RESOLVED, that said plat is hereby approved in all respects.

End of the Year Meeting

At the request of Auditor Susan Williams, the end of the year meeting to hold a budget hearing was set for December 28, 2018 at 10:00 in the Commissioners Meeting Room.

Mental Illness Board Chairman

Auditor Susan Williams informed the Board that the Mental Health Board Chairman for Bennett County is in Pierre. Amanda LaCroix is qualified to be the Mental Health Chairman for Bennett County and has requested the appointment from United Judicial System. Wayne Bond made a motion to submit a letter of support for Amanda LaCroix to be appointed the Mental Health Board Chairman for Bennett County. Rolf Kraft seconded.

All voted aye. Motion carried.

Christmas Eve and New Year’s Eve Holiday

Auditor Susan Williams requested the same holiday schedule for County employees as the Governor had given to state employees. Rolf Kraft made a motion to approve Christmas Eve and New Year’s Eve as paid holiday for Bennett County employees. Rocky Risse seconded.

All voted aye. Motion carried.

SDACC 2019 Legislation

The Board discussed a resolution from the South Dakota Association of County Commissioner’s to present to the 2019 Legislative session to allow counties to authorize a sales tax to issue bonds for construction and renovation of County Courthouses, Jails and Regional Jails. The Commissioners agreed they will need more information.

Chairman Jason Fanning

Jason Fanning stated this would be his last Commissioners meeting and he thanked the Board for serving with him for the last 12 years.

Gravel Crushing Bids

The Gravel Crushing Bids will be opened December 20, 2018 at 10:00 in the Courtroom.

There being no further business to come before the Board Wayne Bond made a motion to adjourn with a second by Jeff Slattery.

All voted aye. Motion carried.
