The Bennett County Board of Commissioners met in regular session Wednesday, February 6, 2019 in the Commissioners Room.

The meeting was called to order at 9:30 a.m. by Chairman Wayne Bond.

The Oath of Office was given to Commissioner Jeff Slattery.

Commissioners present: Wayne Bond, Jeff Slattery, Rod Kirk, Rolf Kraft and Judd Schomp.

Others Present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Sarah Harris, States Attorney; Amanda LaCroix, Attorney; Jerry Bennett, Highway; Kim Clausen, Grant Writer; Steven Parkes, Area Resident.

Minutes Approved

The minutes of the January 16, 2019 meeting was approved with a motion by Rod Kirk and a second by Rolf Kraft.

All Voted Aye. Motion Carried

Auditor’s Account with Treasurer

To the Honorable Board of County Commissioners of Bennett County:

I hereby submit the following report of my examination of the cash and cash items in the hands of the County Treasurer of this County as of January 31st, 2019.

Balance on hand – County $4,542,734.52; Cash Change Account $250.00; Restricted Funds $301,691.76; Savings Accounts $0.00; Cash, Checks, Credit Cards $3,177.24; Treasurer’s Change Fund (- $150.00); NSF Checks $0.00; TOTAL $4,847,703.52

Highway

Jerry Bennett, Highway, met with the Board to report on current road work.

The Board reviewed applications for employment for highway labor. Rod Kirk made a motion to go into executive session at 9:35 a.m. concerning personnel. Rolf Kraft seconded.

All Voted Aye. Motion Carried.

Chairman Wayne Bond declared executive session closed at 9:45 a.m.

Judd Schomp made a motion to interview the employee applicants for highway labor. Rod Kirk seconded.

All Voted Aye. Motion Carried.

Mr. Bennett informed the Board that the weed sprayer pickup needed repair work done. The Board agreed to have the repair done. There was discussion concerning the crushing at the May Pit and the culverts that need cleaned out due to water flooding roads.

The Board reviewed a request for an authorization permit for private citizen to transport county gravel from Rodney Buckles. Rod Kirk made a motion to approve a permit for Rodney L. Buckles to haul 80 truckloads of 25-ton County gravel from the Bauman Pit to 296th St and 217th Ave, one mile south on 217th Ave. Judd Schomp seconded.

All Voted Aye. Motion Carried.

There was discussion about the purchase of a backhoe to clean culverts.

The Board requested the Auditor place an ad for Highway Superintendent.

SDSU Extension MOU with Bennett County

The Board reviewed an MOU with SDSU Extension concerning the 4-H Program in Bennett County. Rolf Kraft made a motion to approve the Memorandum of Understanding between SDSU Extension and Bennett County for 2019. Judd Schomp seconded.

All Voted Aye. Motion Carried.

Law

The Commissioners reviewed the contract for prisoner housing with Charles Mix County for 2019. Rod Kirk made a motion to accept the Prisoner Housing Agreements at the Charles Mix County Law Enforcement Center for 2019. Rolf Kraft seconded.

All Voted Aye. Motion Carried.

There was discussion about the City’s request for use of the jail after hours. Rolf Kraft explained that the City is asking for access to the building by City Officers who are not County employees and when County Law Enforcement is not present. States Attorney Sarah Harris stated the City Officers want to use the cells before transports are done. There was discussion concerning financial arrangements by the City. Judd Schomp and Rod Kirk agreed the decision is up to the Commissioners. Rolf Kraft stated he felt it was the elected officials decision. The group agreed there needs to be a meeting to discuss this request. Judd Schomp made a motion to table the discussion until after the meeting with the City. Rod Kirk seconded.

All Voted Aye. Motion Carried.

Public Defender

There was discussion concerning the feasibility of hiring a public defender. Auditor Susan Williams reported that only a few counties have public defenders and she is still checking on information.

Grant Writer

Kim Clausen, Grant Writer, met with the Board to inform them about the grant writing she had done and the process. There was discussion concerning the needs of the Community. Ms. Clausen explained there were all kinds of grants available and she was willing to help the County. Ms. Clausen stated she would be working with States Attorney Sarah Harris to review the grants available. Steven Parkes, Area Resident, also met with the Board and explained he would work with the group and he felt the drug problem is high priority.

There being no further business to come before the Board, Judd Schomp made a motion to adjourn with a second by Rod Kirk.
