The Bennett County Board of Commissioners met in regular session Wednesday, May 1, 2019 in the Commissioner’s Room.

The meeting was called to order at 9:30 a.m. by Chairman Wayne Bond.

Commissioners present: Wayne Bond, Rolf Kraft, Jeff Slattery, and Judd Schomp.

Absent: Rod Kirk.

Others Present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Terry Smokov, Highway Superintendent; Jeff Siscoe, Director of Equalization; Tony and Rosie Ward, Area Residents; Stephen Parkes, Grant Writer.


The minutes of the regular April 17, 2019 meeting and the April 17, 2019 Board of Equalization were approved with a motion by Rolf Kraft and a second by Judd Schomp.

All voted aye. Motion carried.

Auditor’s Account with Treasurer

To the Honorable Board of County Commissioners of Bennett County:

I hereby submit the following report of my examination of the cash and cash items in the hands of the County Treasurer of this County as of April 30, 2019.

Balance on hand – County $ 5,160,721.82; Cash Change Account $250.00; Restricted Funds $ 303,772.58; Savings Accounts $0.00; Cash, Checks, Credit Cards $139,581.75; Treasurer’s Change Fund - $150.00; NSF Checks $0.00; TOTAL $5,604,176.15

Correction to March Register of Deeds: $1,920.00

April - Register of Deeds: $4,339.00


Terry Smokov, Highway Superintendent, met with the Board to report on current road work. Mr. Smokov informed the Board they are making slow progress on repairing roads because of the moisture.

It was reported that Merle Hicks requested the last two miles of the Hisle Road be finished with gravel.

Mr. Smokov reported there is a culvert caving in on the Allen Road under the asphalt and that it needs to be taken care of. Rolf Kraft presented a letter that had been sent to the Oglala Sioux Tribe, August 9, 2012, granting access to the Allen Road and right-of-way for the purpose of constructing and maintaining the Allen Road. The Board agreed that the Oglala Sioux Tribe accepted the letter and constructed the Allen Road and therefore accepted the terms of maintenance. Mr. Kraft also explained the County had allowed the Tribe to use County roads on the Indian Reservation Program Inventory to help receive funding from the Tribal Transportation Allocation Methodology.

Tony and Rosie Ward, Area Residents, met with the Commissioners to request the culvert on the approach to their residence is plugged and causing water damage to the County road. Mr. Ward informed the Board that Hahn Construction will clear the culvert for $75.00 per hour. The Board discussed if this was a County road and the agreement was it is in the County right-of-way and damaging a County road.

Mr. Smokov reported he is meeting with an engineer to examine the County line road and the Vetal road to see what needs to be done.

Judd Schomp reported the National Guard had met with him and toured some County roads. Mr. Schomp informed the Board there is a possibility for assistance from the National Guard on their weekend training and they would assist the County in how to request future assistance. Mr. Schomp also stated the National Guard does not compete with local contractors and they are interested in assisting communities.

Terry Smokov reported there are still some roads that are impassable but most County residents are patient and compliment the Highway Department on the work being done.

Stephen Parkes, Grant Writer, met with the Board and the Highway Superintendent to report on the work he is doing to have information to use to apply for grants. At this time Mr. Smokov is working with Mr. Parkes to evaluate County roads. There was discussion concerning the process and the Board agreed to support Mr. Parkes in these procedures.

Rolf Kraft made a motion to go into executive session concerning personnel with Terry Smokov at 10:34 a.m. Judd Schomp seconded.

All voted aye. Motion carried.

Chairman Wayne Bond declared executive session closed at 10:51 a.m.

Retail Malt Beverage and South Dakota Farm Wine License

The Board reviewed an application for Retail (on-off sale) Malt Beverage and South Dakota Farm Wine for 2019-2020. Judd Schomp made a motion to approve Boomdocks Bar and Grill, Martin, South Dakota for Retail (on-off sale) Malt Beverage and South Dakota Farm Wine 2019-2020 License. Rolf Kraft seconded.

All voted aye. Motion carried.

Personnel Policy Handbook

The Commissioners were presented with an addition to the Bennett County Personnel Policy Handbook. Rolf Kraft made a motion to make the following addition to the Bennett County Personnel Handbook:

11. All other days designated by the President of the United States or the Governor of the State of South Dakota as a state-wide or nation-wide holiday. Jeff Slattery seconded.

All voted aye. Motion carried.

Poor Lien

The Board considered a request to forgive a poor lien. Judd Schomp made a motion to deny the request to waive a poor lien. Rolf Kraft seconded.

All voted aye. Motion carried.

Deputy Director of Equalization Position

Jeff Siscoe, Director of Equalization, met with the Commissioners to discuss the hire of an Emergency and Disaster Manager or a Director of Equalization Deputy. Mr. Siscoe explained the difference between receiving partial federal funding or being totally funded by the County. The difference between programs is the amount of paper work and time needed to qualify. Bennett County has received federal funding. The Board agreed at this time to hire a Deputy Director of Equalization, Part-Time at 24 hours per week, with benefits and the hours worked will be flexible.

Bennett County Damage Assessment

Jeff Siscoe, Emergency and Disaster Manager, reported the approximate amount of damage submitted for Bennett County’s damage assessment is $210,000.00. This is without labor. The damage assessment has been submitted to the State to review and pool with statewide damage and submit to the President for a disaster declaration to receive federal funding.


The Board discussed parking the surplus patrol car at the Highway yard.

Morning Star Family Ministries, Inc.

The Commissioners reviewed a letter from Morning Star Family Ministries, Inc. informing them they were no longer interested in the County Property of the East 42 feet of Lots 1-2-3; Block 10, Original Town due to the cost of building or moving a structure onto the lot. Morning Star Family Ministries, Inc. offered the County the building and lot for use by the County.


There being no further business to come before the Board, Judd Schomp made a motion to adjourn with a second by Rolf Kraft.

All voted aye. Motion carried.
