The Bennett County Board of Commissioners met in Special Session on Wednesday, June 12, 2019 in the Commissioners meeting room.

The meeting was called to order by Chairman Wayne Bond at 11:00 a.m.

Commissioners present: Wayne Bond, Rolf Kraft, Jeff Slattery, and Judd Schomp. Absent: Rod Kirk.

Others present: Auditor Susan Williams; Taylor Risse, BC Booster; Chad Christiansen, U.S. Fish and Wildlife Service; Sarah Harris, States Attorney; Adam Johnson, Area Land Owner.

Resolution #2-2019

The Board reviewed Resolution #2-2019. Judd Schomp made a motion to accept Resolution #2-2019 Bennett County Disaster Declaration. Rolf Kraft seconded.

All voted aye. Motion carried.

Resolution #2-2019

Bennett County Disaster Declaration

WHEREAS, Bennett County, South Dakota has suffered damage and loss due to heavy rains that fell from May 21, 2019 to May 24, 2019; and

WHEREAS, the Bennett County Board of Commissioners resolve that these conditions constitute a disaster of such severity and magnitude that effective response is beyond the capabilities of the County and there is no emergency plan available to alleviate the damage and economic chaos resulting from these conditions; and

WHEREAS, Bennett County does not have the financial resources to respond to this disaster; and

WHEREAS, due to excessive moisture many residences and infrastructure were inaccessible to first responders, causing a risk for public safety; and

WHEREAS, this is the second event of flooding that had begun with the Ulmer bomb cyclone blizzard and has damaged county roads that had been repaired; and

WHEREAS, this extensive flooding damaged county roads that previously had minimal damage.

NOW, THEREFORE, BE IT RESOLVED, the Board of County Commissioners of Bennett County, South Dakota declare an emergency, and

BE IT FURTHER RESOLVED, we the Board of Commissioners of Bennett County, South Dakota respectfully petition the Governor of the State of South Dakota and the President of the United States to provide with all dispatch and remedies any state and/or federal assistance available for this type of emergency.

Motion passed and Resolution #2-2019 adopted this 12th day of June, 2019.

Highway Department

There was discussion about purchasing a disc and packer that attaches to a road grader. Judd Schomp made a motion to purchase a packer and disc attachment at the discretion of the Highway Superintendent. Rolf Kraft seconded.

All voted aye. Motion carried.

The Board reviewed quotes from contractors to repair damage to the road and to install a culvert on 295th Street west of 208th Avenue. The quotes received were Ceplecha Trucking and Grading, $19,500.00; Hahn Construction, Inc, $18,800.00; Doug O’Bryan Contracting, Inc., $16,139.20. Judd Schomp made a motion to hire Doug O’Bryan Contracting, Inc. for $16,139.20 to begin work June 13, 2019 and complete within 30 days, the installation of a culvert and repair of 295th Street west of 208th Avenue. Rolf Kraft seconded.

All voted aye. Motion carried.

Adam Johnson, Area Land Owner, met with the Board to discuss a road in the south eastern part of the County that has been damaged by water and heavy moisture. Area residents have used an alternate route and requested a new road be constructed on the alternate route because he felt the original road would continue to be flooded. Mr. Johnson stated the area land owners would be willing to help with dirt work and labor and cost and the County would need to provide gravel. The Board agreed to have the Highway Superintendent, the land owner and the area land owners work together on the project. There was also discussion about three auto-gates that need to be placed. The auto-gates needed six concrete bases to be installed. Jeff Slattery made a motion to purchase six concrete bases for the auto-gates. Judd Schomp seconded.

All voted aye. Motion carried.

Mr. Johnson informed the Commissioners the land owners would install the auto-gates.

U.S. Fish and Wildlife

Chad Christiansen, U.S. Fish and Wildlife Service, met with the Commissioners. Mr. Christiansen explained they are planning a renovation project for Cody Lake. Mr. Christiansen informed the Board that part of the project is placing carp screens in Bennett County and they requested permission to do the work. Judd Schomp made a motion to allow the U.S. Fish and Wildlife Service to do the Cody Lake renovation project in Bennett County. Rolf Kraft seconded.

Rental Rate for Contractors

Auditor Susan Williams informed the Commissioners that Bennett County needed to set a rental rate for contractors’ equipment for disaster assessment purposes. Jeff Slattery made a motion to set rental rates for contractors’ equipment at $100.00 per hour. Judd Schomp seconded.

All voted aye. Motion carried.

Allen Road Repair

Judd Schomp informed the Board that the Oglala Sioux Tribe Department of Transportation did not provide hot mix to repair the Allen Road as per the agreement June 5, 2019. Because of the continued deterioration of the road and safety issues the County Highway Department is repairing the road at this time with fill dirt and gravel. Judd Schomp stated he is in contact with James Cross and Craig Dillon concerning hot mix from the Tribe.


There being no further business to come before the Board Judd Schomp made a motion to adjourn with a second by Rod Kirk.

All voted aye. Motion carried.
