The Bennett County Board of Commissioners met in regular session Wednesday, June 5, 2019 in the Commissioner’s Room.

The meeting was called to order at 9:30 a.m. by Chairman Wayne Bond.

Commissioners present: Wayne Bond, Rolf Kraft, Jeff Slattery, Rod Kirk and Judd Schomp.

Others Present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; James Cross, OST Council Member; Craig Dillon, OST Council Member; Sarah Harris, States Attorney; Terry Smokov, Highway Superintendent; Jolene Donovan, Treasurer.

Minutes

The minutes of the regular May 16, 2019 meeting were approved with a motion by Judd Schomp and a second by Rod Kirk.

All Voted Aye. Motion Carried.

Auditor’s Account with Treasurer

To the Honorable Board of County Commissioners of Bennett County:

I hereby submit the following report of my examination of the cash and cash items in the hands of the County Treasurer of this County as of May 31, 2019.

Balance on hand – County $5,078,323.21; Cash Change Account $250.00; Restricted Funds $303,818.61; Savings Accounts $0.00; Cash, Checks, Credit Cards $16,102.64; Treasurer’s Change Fund - $150.00; NSF Checks $0.00; TOTAL $5,398,344.46

May - Register of Deeds: $11,764.00

Highway Department

James Cross and Craig Dillon, representatives for the Oglala Sioux Tribe tribal council, met with the Board to discuss the Allen Road. Rolf Kraft presented information on the history of the Allen Road and documentation used concerning maintenance and repair of the Allen Road by the Tribe. There was discussion about the Indian Reservation Roads used by the Federal Government to designate funds to the Tribe to use for repair and maintenance which included the Allen Road. Mr. Cross stated he feels the Allen Road is the responsibility of the County but the priority at this time is the repair needed on the road. The Board agreed the main concern is the repair and the County needs the assistance of the Tribe. There was discussion about how to repair the road. There was a conference call with Rod Rouillard, OST Department of Transportation. It was decided the Oglala Sioux Tribe would provide hot mix and the County would lay it and pack it. The group also agreed they needed to meet and make an agreement about future maintenance.

Terry Smokov, Highway Superintendent, reported on the repair work being done at this time. Rod Kirk requested the need to repair roads in the southeastern part of the County. There was discussion about the number of employees needed, the number of culverts and equipment needed. There was also discussion about the budget and funding for the repairs and reconstruction of damaged roads.

Bids for Surplus Vehicle

Bids for the surplus vehicle were opened at 10:00 a.m. The following bids were opened:

City of Martin: $2,510.00

Kristine Novak: $1,257.00

David Hancock: $5,150.00

Michael Coller: $1,900.00

Baybridge Motors: $1,355.00

Brittany Soderlin: $500.00

Rod Kirk made a motion to accept the high bid of $5,150.00 for the surplus vehicle 2013 Ford Taurus from David Hancock. Judd Schomp seconded.

All Voted Aye. Motion Carried.

Department of Public Health Notice

The Board reviewed a notice from the South Dakota Department of Public Health for a disinterment of a body from the Martin Community Cemetery.

Record Retention and Destruction Schedule

At the request of Auditor Susan Williams Rod Kirk made a motion to approve the Bennett County Emergency Management Record Retention and Destruction Schedule. Jeff Slattery seconded.

All Voted Aye. Motion Carried.

Catastrophic Legal Expense Relief Program

Auditor Susan Williams informed the Commissioners that the SDACC Catastrophic Legal Expense Relief Program had reimbursed the County $95,131.25 for the Daniel Ceplecha and Rangler Ceplecha 1st Degree Manslaughter Case. Total cost to the County was $166,894.45. The cases are in appeal and claims will continue to be submitted to CLERP.

Courthouse Roof

There was discussion about the leak in the Courthouse roof. The Board agreed to have just the leak fixed at this time.

Surplus Equipment

Jeff Slattery made a motion to surplus the following equipment at no value: #0029 Kodak Slide Projector; #0664 Smith Corona XL Electronic Typewriter; #1271 Gateway Monitor; #1272 Gateway Tower; #1904 Dell Monitor; #1905 Dell Tower; #0261 Brother Typewriter. Rod Kirk seconded.

All Voted Aye. Motion Carried.

Emergency Action Plan

The Board reviewed an Emergency Action Plan for the Courthouse. Jeff Slattery made a motion to approve the Plan. Rod Kirk seconded.

All Voted Aye. Motion Carried.

Executive Session

Rod Kirk made a motion to go into executive session concerning personnel with the States Attorney at 10:40 a.m. Judd Schomp seconded

All Voted Aye. Motion Carried.

Chairman Wayne Bond declared executive session closed at 10:50 a.m.

There being no further business to come before the Board, Judd Schomp made a motion to adjourn with a second by Rod Kirk.

All Voted Aye. Motion Carried.
