The Bennett County Board of Commissioners met in regular session Wednesday, June 19, 2019, in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Chairman Wayne Bond.

Commissioners present: Wayne Bond, Rolf Kraft, Judd Schomp, Jeff Slattery and Rod Kirk.

Others present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Butch Fanning and Jerry Lyon Area Residents; Jeff Siscoe, Emergency and Disaster Manager; Gerald Novak, Area Resident; Sarah Harris, States Attorney; Sheriff Paul Williams; Chief Deputy Jason Erwin.

Minutes Approved

Rolf Kraft made a motion to approve the minutes of the regular June 5, 2019 meeting and the special June 12, 2019 minutes. Rod Kirk seconded.

All voted aye. Motion carried.

Highway Department

Gerald Novak, area land owner, requested payment for oversize rock he had purchased and laid down on County Road 205th Avenue to repair the road damaged in the blizzard and flood. The Board discussed the fact that residents who work on County roads need to have pre-approval and the County will not know if they will be reimbursed with disaster funds. The Board agreed to pay this bill but future work done by land owners or residents will not be paid without pre-approval.

Rod Kirk made a motion to go into executive session at 9:38 a.m. concerning possible litigation. Jeff Slattery seconded.

All voted aye. Motion carried.

Executive Session-Personnel

Rolf Kraft made a motion to go into executive session at 9:54 a.m. concerning personnel. Rod Kirk seconded.

All voted aye. Motion carried.

Chairman Wayne Bond declared executive session closed at 10:11 a.m.

Highway Department

The Board discussed the FY 2019 Signing and Delineation Project through the South Dakota Department of Transportation. Judd Schomp and Rod Kirk expressed concern about some of the signs. Rolf Kraft explained the reason the County entered into the agreement was because of the liability to the County and safety of the citizens. The Board agreed the project would go forward.

There was a complaint about Old Highway 18 north of Martin. The Board was aware of the condition of the highway and discussed options. The resurfacing of the road would be financially difficult and there is too much damage to fill holes with asphalt. They discussed grinding up the asphalt and use gravel and binder. The Board agreed the public would need to have input and this would have to be a future project. Area residents had agreed to fill pot holes if the County would place a load of gravel in the area. The Board agreed to have the Highway Department dump a load of gravel for area residents to fill the pot holes.

There was discussion concerning the damaged roads being posted with road closure signs and warning flags and the signs are being stolen. The Commissioners expressed their frustrations at trying to keep roads posted for the safety of the public.

Jeff Siscoe met with the Board to request the Allen Road repair be permanently fixed. There was discussion concerning reimbursement from South Dakota Department of Transportation Program.

It was reported that James Cross and Craig Dillon were talking to the Oglala Sioux Tribe about asphalt for the repair. The Board agreed the County has done everything they can.

Law Department Complaint

Sheriff Williams met with the Board to discuss a complaint against the law department reported to Judd Schomp. The complaint from Chief Brandon Petersen concerning an incident June 13, 2019 with a stolen car and a hit and run and pursuit. Sheriff Williams and Chief Deputy Jason Erwin informed the Board of their actions and that everyone had cooperated and worked together during the incident and they did not understand the complaint to Judd Schomp after the fact and the law department was not informed about the complaint. There was discussion about circumstances after the arrest and use of the jail. Sheriff Williams explained when there are no jailers available, they are unable to hold inmates and Officer Chester had reported to Chief Deputy Jason Erwin that everything was good. Sheriff Williams expressed his frustration because he felt the departments had been working well together. The Commissioners requested the Sheriff’s Department report on activities once a month.

Director of Equalization

Rod Kirk made a motion to go into executive session with Director of Equalization Jeff Siscoe concerning personnel at 10:45 a.m.

All voted aye. Motion carried.

Emergency and Disaster Manager

Jeff Siscoe, Emergency and Disaster Manager, met with the Board to inform them about a FEMA program for area residents with damage to their homes. There was discussion about County roads and the process for getting reimbursement from FEMA.


The Board reviewed claims and questioned some of the highway claims. Rolf Kraft made a motion to approve claims subject to delinquent taxes with a second by Rod Kirk.

2020 Budgets

Auditor Susan Williams presented budget requests for 2020 to the Board and also informed the Board the per diem rates for the State would increase effective July 1, 2019. The County follows State rates. Breakfast stay at $6.00, Lunch $11.00 to $14.00, Dinner $15.00 to $20.00. Mileage rate will stay at 0.42¢ per mile.


There being no further business to come before the Board Rod Kirk made a motion to adjourn with a second by Rolf Kraft.

All voted aye. Motion carried.
