The Bennett County Board of Commissioners met in regular session Wednesday, September 18, 2019, in the Commissioner’s meeting room.

The meeting was called to order at 9:30 a.m. by Chairman Wayne Bond.

Commissioners present: Wayne Bond, Rolf Kraft, Judd Schomp, Jeff Slattery and Rod Kirk.

Others present: Susan Williams, Auditor; Taylor Risse, Bennett County Booster; Terry Smokov, Highway Superintendent; Jerry Heiser, Butler Machinery; Wade Iszler, RDO Equipment Co.; Sarah Harris, States Attorney; Jesse Ulmer, Ed Johnson, Justin Friese, Highway Department; Jonathan Bad Wound, Area Resident; Paul Noel, City Foreman; Paul Williams, Sheriff; Jolene Donovan, Treasurer.

Minutes Approved

Motion was made by Rolf Kraft to approve the September 4, 2019 regular meeting minutes. Seconded by Rod Kirk.

All voted aye. Motion carried.

Highway Department

Terry Smokov, Highway Superintendent, reported on the FEMA sites as of today 18 out of 26 sites are done at 100%. More culverts are going in at different places. There was one more FEMA site added, it somehow got overlooked Bud Road, without any problems. The new blade is working out great and getting lots of gravel laid on several roads.

It was stated that the two loads of cold mix on Old Highway 18 North covered a good area and residents were happy with it. There was discussion on several roads needing to be cared for before winter hits.

Mr. Smokov stated he has a few more culverts coming, and has some in surplus. There was discussion about some area roads needing bladed, but Highway Superintendent Terry Smokov stated he is under a deadline on the FEMA sites so they take top priority.

Judd Schomp made a motion to hire Benjamin Rostyne effective August 9, 2019 at $13.00 hourly, as Part-Time Highway Labor. Rod Kirk seconded.

All voted aye. Motion carried.

Judd Schomp made a motion to hire Kevin White Face effective September 4, 2019 at $13.00 hourly, as Part-Time Highway Labor. Seconded by Rolf Kraft.

All voted aye. Motion carried.

Judd Schomp informed the Board that Oglala Sioux Tribe repaired Allen Road with cold mix and it is in much better condition. There was also talk about a maintenance agreement for the Batesland Housing Road, but haven’t heard anything back from Oglala Lakota County.

Area Resident, Jonathan Bad Wound, asked the Board if they are going to be hauling gravel, and the Board told him to talk to Terry Smokov, Highway Superintendent.

There was talk about implementing a five-year plan for roads. There was discussion on what roads need to take priority. The Board discussed getting as much base work done on as many roads as the Highway Department can before winter hits and to keep inline with the budget. This would give a better set-up for spring work.

Terry Smokov, Highway Superintendent, requested to surplus a 1986 Ford LTL9000 Truck to sell on Purple Wave site. Purple Wave representative will be at the County Shop tomorrow to get all equipment ready to be auctioned off on their site. Motion was made by Rod Kirk and seconded by Judd Schomp.

All voted aye. Motion carried.

Mr. Smokov informed the Board that he is going to purchase radios for the highway department.

Paul Noel, City Foreman, approached the Board about purchasing surplused paddle scrapper. The Commissioners stated there are several people interested so it needs to go through Purple Wave site.

Jerry Heiser, Butler Machinery Company, presented information on a 2006 CAT 143H Motorgrader and a 2001 CAT 143H Motorgrader with low hours. Wade Iszler, RDO Equipment, presented information on a John Deere grader. After some discussion among the Board and Highway Department. Rod Kirk made a motion to purchase a 2006 CAT 143H and 2001 CAT 143H, through Sourcewell, for $200,000.00 with a five-year payment plan. Judd Schomp seconded.

All voted aye. Motion carried.


There was some discussion on a few of the claims. Judd Schomp asked if there has been any more information on mental illness owed to us from Jackson County, and Sarah Harris, States Attorney, said she hasn’t heard anything back from IHS. After more discussion on claims Jeff Slattery made a motion to approve claims subject to delinquent taxes. Rod Kirk seconded.

All voted aye. Motion carried.

Resolution #4-2019 2020 Annual Budget

Rod Kirk made a motion to approve Resolution #4-2019 2020 Annual Budget with the following changes: General Fund Taxes: $1,818,644.00 to 1,811,797.00; Fire Fund Taxes: $18,628.00 to $24,464.00; Capital Outlay Accumulations: $85,100.00 to $78,598.00 and Fire Budget Other Expense: $18,000.00 to $24,000.00. Jeff Slattery seconded.

All voted aye. Motion carried.

Motion made by Rod Kirk for Capital Outlay Accumulations of $78,598.00 be accumulated for Courthouse Maintenance and Repair. Seconded by Wayne Bond.

All voted aye. Motion carried.

Law Department

Sheriff Paul Williams presented his monthly report to the Board. Sheriff Williams also discussed surplusing equipment out of the surplused Ford Taurus.

Cozad Endowment

Auditor Susan Williams informed the Commissioners that Fred and Luella Cozad left their city property to the County and City. Jeff Slattery made a motion to have Auditor Susan Williams be appointed as the person to act on behalf of Bennett County for the Cozad Endowment. Rolf Kraft seconded.

All voted aye. Motion carried.

Budgeted Fund Transfer

There is a budget request from Auditor Williams to transfer funds from the General fund to the following: 911 Fund: $11,690.00; Emergency and Disaster Fund: $11,043.00; 24/7 Fund: $8,225.00 with a motion made by Rod Kirk seconded by Jeff Slattery.

All voted aye. Motion carried.

Camera System

States Attorney, Sarah Harris, presented a quote for a camera system for the Courthouse building excluding the jail.


There being no further business to come before the Board Rolf Kraft made a motion to adjourn with a second by Rod Kirk.
