The Bennett County Board of Commissioners met in Special Session on Thursday, November 14, 2019 in the Courtroom.

The meeting was called to order by Chairman Wayne Bond at 9:30 a.m.

Commissioners present: Wayne Bond, Rolf Kraft, Jeff Slattery, Rod Kirk and Judd Schomp.

Others present: Auditor Angie Hicks, Jerry Heiser and Dan Werdel of Butler Machinery, Bennett County Sheriffs Office Chief Deputy Jason Erwin, Taylor Risse Booster, Terry Smokov Highway Superintendent, Jolene Donovan Treasurer, Sarah Harris States Attorney.

Butler Machinery Equipment

This special meeting is due to several issues with the 2001 & 2006 143H motor graders purchased from Butler Machinery. Jerry Heiser and Dan Werdel of Butler Machinery are here to work through these issues and save the deal to move forward.

The most issues are with the 2001, however noises are being heard in both of the rear ends, maybe differentials locked up. There was a discussion about how the machines operate. Jerry Heiser also stated that when blading you need to have the differential locked in. Terry Smokov, Highway Superintendent also stated that the 2001 moldboard chatters when blading, causing washboards. The 2006 was having problems with the blade breaking back too easily.

The Board expressed concern with the mechanic’s inspection, and some issues that were possibly not found that should have been, such as the noises. Mr. Heiser stated that they missed a front bushing and Butler fixed that at their expense. Some of these issues were found when they started driving them, and the mechanics didn’t drive them.

Dan Werdel, Butler Machinery, stated that they stand behind the mechanics and machines, and they are willing to do a 50/50 8 Month or 400-Hour Warranty. Mr. Werdel stated, everything else works well, and we will take the 2001 and fix the rear end as well as the moldboard chattering because we sold them as working machines and these will be fixed at Butler’s cost. Any issues found after that will be covered by the 50/50 8 Month or 400-Hour Warranty.

Mr. Heiser is going to send a mechanic down from Butler to go over the slip clutch adjustment process with one of the Highway laborers for the 2006 causing the blade breaking back too easily. Mr. Werdel added that if it does end up being a differential lock issue on the 2006, they will fix that at Butler’s cost.

The Board was very impressed with Butler’s cooperation and willingness to correct these issues. Rod Kirk made the motion to have Butler correct the issues with the 2001 and 2006 143H machines and accept the 50/50 8 Month or 400 hour Warranty. Rolf Kraft seconded.

All voted aye. Motion carried.

Commissioner Bond thanked the Highway Department for fixing the road near his place.

There being no further business to come before the Board, Judd Schomp made a motion to adjourn, seconded by Jeff Slattery.
